Welcome to Circle of Consciousness & Happiness (“COCH,” “Circle,” “Organization,” “we,” “our,” or “us”).
These Terms of Use (“Terms”) govern access to and use of the website located at circleofconsciousness.org, participation in any event, conference, workshop, seminar, educational activity, community circle, club, retreat, gathering, online session, communication platform, awareness initiative, publication, research activity, or any other program conducted, facilitated, organized, sponsored, authorized, or supported by the Organization.
By accessing our website, registering for an event, participating in any activity, submitting information, attending a session, or otherwise interacting with the Organization, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.
If you do not agree with these Terms, you should discontinue use of the website and refrain from participating in Organization activities.
Circle of Consciousness & Happiness is a California Nonprofit Public Benefit Corporation organized exclusively for charitable, educational, and public-benefit purposes and recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code.

The Organization exists to facilitate educational, reflective, awareness-oriented, community-based, cultural, and public-benefit activities intended to support dialogue, learning, observation, personal responsibility, community participation, and human development.
Participation in Organization activities is limited to individuals who are eighteen (18) years of age or older.
By participating, you represent and warrant that you are at least eighteen years old and possess the legal capacity to enter into binding agreements.
The Organization reserves the right to deny access, revoke participation, or terminate involvement at any time if eligibility requirements are not satisfied.
The Organization provides educational, awareness-oriented, community-building, charitable, reflective, cultural, and public-benefit activities.
Activities may include discussions, workshops, conferences, community circles, self-inquiry exercises, reflective practices, meditation-related activities, awareness-based exercises, educational presentations, participant sharing, experiential learning opportunities, and similar programs.
Participants acknowledge that individual experiences may differ significantly and that participation may involve exposure to differing perspectives, opinions, beliefs, observations, interpretations, experiences, and viewpoints.
Participation is voluntary at all times.
No individual is required to disclose personal information, experiences, beliefs, or perspectives.
The Organization does not provide medical, psychiatric, psychological, therapeutic, counseling, coaching, healthcare, legal, financial, accounting, tax, investment, employment, relationship, or professional advisory services.
Nothing contained on the website, in any publication, during any event, within any conference, workshop, presentation, conversation, discussion, session, communication, or interaction shall be construed as professional advice.
No participant, volunteer, host, speaker, presenter, facilitator, officer, director, committee member, advisor, or representative of the Organization is acting as your physician, therapist, psychologist, psychiatrist, attorney, financial advisor, accountant, counselor, fiduciary, or licensed professional by virtue of participation in Organization activities.
You remain solely responsible for obtaining professional advice appropriate to your individual circumstances.
The Organization does not diagnose, treat, cure, monitor, manage, or prevent any medical, psychiatric, psychological, emotional, behavioral, neurological, developmental, or mental health condition.
Participation in awareness-oriented discussions, reflective exercises, meditation-related activities, self-inquiry processes, community dialogue, or educational programs may result in emotional reactions, personal insights, intellectual challenges, or changes in perspective.
Participants acknowledge that such experiences vary significantly among individuals.
Individuals experiencing emotional distress, mental health concerns, medical emergencies, suicidal thoughts, psychiatric crises, or other health-related issues should immediately consult qualified healthcare professionals or emergency services.
The Organization assumes no responsibility for decisions made by participants concerning medical, psychological, therapeutic, psychiatric, or healthcare matters.
The Organization makes no representation, warranty, guarantee, promise, prediction, or assurance regarding any outcome resulting from participation.
Without limitation, the Organization does not guarantee:
Participants acknowledge that outcomes, if any, depend upon numerous factors outside the Organization’s control.
Participants remain solely responsible for their own decisions, actions, conduct, interpretations, conclusions, beliefs, relationships, finances, employment decisions, educational decisions, healthcare decisions, legal decisions, and personal choices.
Nothing provided by the Organization should be interpreted as directing or requiring any particular course of action.
Participants assume full responsibility for evaluating, accepting, rejecting, modifying, or disregarding any information encountered through participation.
Participation in Organization activities is entirely voluntary.
You acknowledge that participation may involve emotional, intellectual, interpersonal, psychological, social, spiritual, educational, or experiential risks that cannot be fully anticipated.
You voluntarily assume all risks associated with participation, including but not limited to reactions arising from discussions, reflections, awareness exercises, self-inquiry processes, meditation-related activities, community interactions, differing viewpoints, personal disclosures, and interpersonal engagement.
You participate entirely at your own discretion and risk.
Organization activities may be recorded through audio recordings, video recordings, photography, screenshots, transcripts, written documentation, interviews, presentations, or other media.
By participating in activities where recording occurs, you acknowledge that your voice, image, likeness, statements, comments, participation, presentations, questions, and contributions may be captured.
The use of such materials shall be governed by applicable participant consents, waivers, releases, and media authorization agreements.
All content available through the Organization, including but not limited to text, documents, publications, recordings, presentations, educational materials, methodologies, graphics, logos, trademarks, service marks, videos, audio content, forms, designs, systems, organizational materials, websites, databases, and related content are owned by or licensed to the Organization unless otherwise stated.
No content may be copied, reproduced, distributed, published, modified, transmitted, displayed, sold, licensed, or exploited without prior written authorization.
Unauthorized use may result in suspension of participation, removal of access, legal action, or other remedies available under applicable law.
Participants agree not to:
The Organization reserves the right to remove, suspend, restrict, or terminate participation at its sole discretion.
The Organization may utilize third-party platforms, conferencing tools, registration systems, communication tools, websites, survey platforms, educational platforms, and related technologies.
The Organization does not control and is not responsible for the operation, availability, privacy practices, security, performance, policies, actions, omissions, content, or conduct of third-party providers.
Participants assume responsibility for reviewing applicable third-party terms and policies.
The Organization’s directors, officers, volunteers, facilitators, speakers, hosts, conveners, members, participants, and affiliated individuals may independently conduct activities outside the scope of the Organization.
Unless expressly approved by the Board of Directors as an official Organization activity, such independent activities are conducted solely in the individual’s personal capacity and shall not be attributed to the Organization.
The Organization assumes no responsibility for independent programs, services, events, retreats, workshops, seminars, consultations, coaching arrangements, advisory engagements, teachings, transactions, payments, or activities conducted outside its authorized programs.
To the fullest extent permitted by law, the website, programs, events, materials, activities, content, publications, services, and resources are provided on an “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS” basis.
The Organization expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, reliability, availability, non-infringement, or uninterrupted access.
To the fullest extent permitted by law, the Organization and its directors, officers, volunteers, hosts, facilitators, speakers, committee members, advisors, representatives, affiliates, agents, successors, and assigns shall not be liable for any direct, indirect, incidental, special, consequential, punitive, exemplary, emotional, reputational, economic, personal, educational, professional, spiritual, or other damages arising from or related to participation.
This limitation applies regardless of legal theory, including contract, tort, negligence, strict liability, statutory claims, or otherwise.
If liability is nevertheless imposed, the maximum aggregate liability of the Organization shall not exceed one hundred United States dollars (USD $100).
You agree to defend, indemnify, and hold harmless the Organization and its directors, officers, volunteers, hosts, facilitators, speakers, representatives, affiliates, and agents from and against any claims, demands, liabilities, damages, losses, costs, expenses, judgments, settlements, penalties, and attorneys’ fees arising from your conduct, participation, actions, omissions, violations of these Terms, or misuse of Organization resources.
These Terms shall be governed exclusively by the laws of the State of California, without regard to conflict-of-law principles.
Before commencing any legal proceeding, the parties shall attempt in good faith to resolve disputes through confidential mediation conducted in San Diego County, California.
Any dispute not resolved through mediation shall be resolved exclusively through final and binding arbitration in San Diego County, California.
The arbitration shall be administered by a mutually agreed arbitration provider and conducted in English.
The arbitrator’s decision shall be final and enforceable in any court having jurisdiction.
You agree that any claim shall be brought solely in your individual capacity.
You waive any right to participate in class actions, representative actions, collective actions, consolidated proceedings, or similar multi-party litigation.
To the fullest extent permitted by law, all parties knowingly and voluntarily waive any right to a jury trial.
The Organization shall not be liable for delays, interruptions, failures, cancellations, or inability to perform resulting from circumstances beyond its reasonable control, including natural disasters, public health events, governmental actions, internet outages, technology failures, labor disruptions, civil unrest, war, acts of God, or similar events.
The Organization reserves the right to modify these Terms at any time.
Updated Terms shall become effective upon posting unless otherwise stated.
Continued use of the website or participation in Organization activities after publication of revised Terms constitutes acceptance of the updated Terms.
